RULES AND CONDITIONS OF USE

1. 
These rules and conditions of use (Rules) apply to you. Your access to or use of www.JobShidduch.com (the Website) regardless of whether such access or use is intended is subject to the terms of these Rules. Please read these Rules carefully before you apply to register on the Website and before you start to use the Website. By registering on the Website, you accept these Rules and agree to abide by them. You should print a copy of these Rules for future reference.

2.  The Website is owned by Hampstead Garden Suburb Synagogue (Us or We or HGSS). Our address is Norrice Lea London N2 0RE. Day to day operation of the Website will be carried out by a person acting upon our behalf (the Site Adminstrator). References in these Rules to Us or We will be deemed to include the Site Administrator where appropriate.

3.  In order to access some features of the Website, you will have to register by providing information about yourself. After you have registered you will be entitled to utilise the Website to find jobs or fill vacancies. You are solely responsible for your profile and any activity on it, and must keep your profile password secure. We will not be liable for any losses caused by any unauthorised use of your profile.

4.  All messages and emails sent to the Website will need to be approved by Us - this is to ensure that they are appropriate and in good taste ! We will try our best to ensure that messages and emails are passed on as soon as possible. It should be remembered however that everyone gets lots of emails anyway, so We ask that postings be as concise as possible. We reserve the right to reject or amend any email or messsage which We consider to be inappropriate for distribution to members of the Website (Members)

  Messages do not reflect the opinions or policies of HGSS. HGSS is not responsible for any information contained in any messages.

6.  Unless it is absolutely relevant, please remove any portions of previous emails sent to you if you decide to pass a message on to the Website

7.  If attachments are sent in with a message or email, We will check that these are of acceptable size and may reject any message if this is not the case. Ideally messages (including attachments) should not exceed 1 mb. Please name any attachment file appropriately

8.  We have a strong preference for messages posted by Members to show the full 'real name' of the sender either in the email address or in the body of the message. Where however a Member wishes a message or email to be posted or sent anonymously the following process will apply:

     8.1  We must be informed of the identity of the person posting the message or email

     8.2  the message or email must be sufficiently detailed to describe to Members, in the absence of the identity of the person posting the message: (a) in the case of a Member looking for work - the general work credentials of that person and/or the type of job he/she is looking for; and (b) in the case of a Member who has a job position available - a general description of the job and the credentials required of any person applying for it

     8.3  the message must include a reference number or description to allow Members to respond to the person posting the message to express interest or obtain further information regarding the subject job position or applicant. Members responding to an anonymous posting are required to disclose their identity. and

     8.4  We reserve the right to reject any message or email that does not meet the conditions set out in 8.1, 8.2 and 8.3 above

9.  We reserve the right to deregister any Member who persistently misuses the Website or who, in the opinion of Us, is guilty of any other conduct which could bring Us or the Website into disrepute 

10.  Any action that you take following receipt of a message is taken entirely at your own risk. You are responsible for ensuring that any Member selected to fill a position or any job accepted (as applicable) is appropriate for you and you are responsible for doing your own due diligence into such matters, and no guarantee is given by Us in this regard. Contracts between Members in response to job applications or vacancy postings on the Website, including between Members responding to an anonymous posting, shall be concluded independently of HGSS and the Website. The terms of any contract, including work scope and compensation, will need to be settled between the Members themselves and their respective advisors. To the fullest extent permitted by law, We give no representations or warranties about any messages or any action relied upon by you using the Website. 

11.  Once a posted job vacancy or application has been filled (or if a Member for any reason wishes to remove his or her posting from the Website) the Member responsible for such posting shall promptly advise the Site Administrator so that the website can be amended accordingly

12.  Using the website to pass on messages for third parties will NOT be encouraged especially if those parties are not members of HGSS. This rule will however be exercised at our discretion. You acknowledge and agree that We may, after registration, check that you are a member of HGSS.

13.  At the discretion of the  Site Adminstrator members of HGSS who are employment consultants or agents will be able to register on the Website. The Site Adminstrator may however impose conditions of such registration including requiring that any such member: (a) discloses on the Website that he or she is an employment consultant or agent; (b) undertakes not to apply (including for or on behalf of any other member of HGSS) for any job or vacancy posting placed on the Website by another member who is an employment consultant or agent, or to directly contact the principal upon whose behalf such placement has been made in connection with any such job or vacancy.

14.  We process information about you in accordance with our privacy policy - details of which can be accessed on the log-in page to the Website. By using the Website, you consent to such processing. You acknowledge that information you provide may be exchanged electronically.

15.  These Rules remain in full force and effect while you are using the Website. We may terminate your registration and your access to the Website if you provide false information or, in our reasonable opinion, abuse the services offered by the Website.

16.  You must not misuse the Website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial of service attack or a distributed denial of service attack or by any other means recognised as an attack vector.

17.  We may modify these Rules from time to time and any such modification will be effective as soon as We have posted it on the Website. You agree to be bound to any changes to these Rules upon your use of the Website after such modification is posted.

18.  Our liability for any matter for which it would be illegal for Us to exclude liability is not excluded.

19.  Any notice to give to Us must be given to Us via the Site Administrator (using the "Contact Us" link on the log-in page to the Website) or at DavidSagal@hgss.org.uk.

20.  These Rules are to be governed and construed in accordance with English law. The courts of England and Wales will have non-exclusive jurisdiction to settle any claim in connection with these Rules. 

PLEASE NOTE !

The Website is a non-profit service free to members of HGSS, in respect of which neither We, the  Site Administrator nor any officer of HGSS receives payment

Subject to paragraph 18 above, none of the Website, HGSS, the Site Adminstrator or any officer or employee of HGSS will be liable for or in relation to:


(a)  the accuracy or otherwise of the information posted or exchanged in messages and emails on the Website including as regards the credentials or suitability of Members looking for jobs AND as regards the actual availability and the accuracy of descriptions of jobs which are posted IN EITHER CASE including where a message or email has been edited or amended by Us before being released

(b) any reliance placed on any message provided to you by Us or posted and/or distributed on the Website

(c)  the outcome of any job application or placement through the Website including the suitability of the job AND the suitability of the candidate for any posted job AND in the event that a candidate is placed into a job through the website, of the success of the job or the candidate within it

(d)  any direct, indirect or consequential loss or damage incurred by you in connection with the Website or in connection with the use of the Website or any website linked to the Website, including, without limitation, and liability for: (i) loss of income or revenue; (ii) loss of business; (iii) loss of profits or contracts; (iv) loss of anticipated savings; (v) loss of data; (vi) wasted management or office time; (vii) loss of goodwill; (viii) corruption of data; (ix) unathorised access to or use of secure servers and/or any personal information stored tereon; (x) viruses, trojans, worms, logic bombs, attack vectors or other material which is malicious or technologically harmful which may be transmitted to or through the Website by any third party; (xi) errors or omissions in any message; and (xii) for any loss or damage of any kind, however arising and whether caused by tort (including negligence) breach of contract or otherwise, even if foreseable.
